A DERELICT building can now be bulldozed by a council after a High Court judge kicked out a legal challenge by its owners.
The owner of the former ICI building Billingham House, in Billingham, near Stockton, had brought a judicial review against Stockton Borough Council to stop it demolishing the building.
It argued the company, Bizzy B, had plans to redevelop the site, but Deputy Judge Charles George rejected the plans.
Lawyers for Bizzy B said they would now seek leave to take their case to the Court of Appeal.
In an out-of-court agreement pending the appeal, the council promised not to demolish the building before noon on Monday, September 5, however, the council said any appeal would “frankly be nothing other than a delaying tactic”.
